Welcome to RoofingRebuilder.com ("Roofing Rebuilder," "we," "us," or "our").
These Terms of Use ("Terms") govern your access to and use of RoofingRebuilder.com (the "Website"), including all content, features, services, forms, and information made available through the Website.
Roofing Rebuilder operates an online platform designed to connect homeowners with independent home improvement contractors, service professionals, and related service providers.
By accessing or using the Website, or by submitting information through our forms after receiving notice of these Terms, you acknowledge that you have read and agree to these Terms to the extent a legally enforceable agreement is formed.
PLEASE READ THESE TERMS CAREFULLY. SECTION 15 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION.
If you do not agree with these Terms, please discontinue use of the Website.
1. DESCRIPTION OF SERVICES
Roofing Rebuilder provides a free online service intended to help homeowners locate and connect with independent contractors and service professionals offering roofing and related home improvement services.
Through the Website, users may submit requests for estimates, quotes, consultations, or additional information regarding home improvement projects.
Roofing Rebuilder may share submitted inquiries with independent contractors, service providers, advertising partners, or other third-party partners to facilitate matching homeowners with relevant services.
Roofing Rebuilder is not a general contractor and does not directly perform construction, remodeling, installation, or repair services unless expressly stated otherwise.
All participating contractors and service professionals operate independently.
Roofing Rebuilder does not guarantee that a homeowner will receive a quote, qualify for a service, be matched with a contractor, or enter into an agreement with any service provider.
2. ELIGIBILITY AND ACCEPTANCE
By submitting a request through the Website, you represent that:
- You are at least 18 years old.
- You have the legal capacity to enter into a binding agreement.

You understand that submitting a service request does not guarantee a contractor match, an estimate, or the availability of any specific service.
You are not obligated to purchase any service solely because you submit an inquiry through the Website.

Roofing Rebuilder will process applicable opt-out and consent-revocation requests in accordance with governing law.

Unless expressly stated otherwise, these third parties are not employees, agents, representatives, or subsidiaries of Roofing Rebuilder.

Nothing in this section excludes liability that applicable law does not permit us to exclude.

The Website may contain links to third-party websites, applications, platforms, or services.
These third-party resources operate independently from Roofing Rebuilder.
We do not control their content, security practices, privacy policies, or business operations.
The inclusion of a third-party link does not necessarily constitute endorsement.
Your use of third-party websites is governed by their respective terms and privacy policies.
Roofing Rebuilder is not responsible for losses or disputes arising from independent third-party websites except to the extent required by applicable law.
11. LEAD QUALITY AND NO AGED LEAD POLICY
Roofing Rebuilder is committed to transparency and quality in its lead generation operations.
Our standard business practice is not to knowingly represent aged, recycled, reused, or previously sold consumer inquiries as newly generated leads.
Consumer inquiries generated through the Website or related marketing activities are distributed according to applicable campaign requirements and agreements with participating business partners.
Where an inquiry has previously been distributed or monetized, its status should be disclosed when required by the applicable commercial arrangement.
Specific lead quality requirements, delivery methods, exclusivity conditions, return policies, and other commercial terms may be established through separate written agreements with business partners.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
Roofing Rebuilder makes no guarantee that the Website will operate continuously, without interruption, or without technical errors.

Roofing Rebuilder does not independently guarantee:
- Contractor availability.
- Contractor licensing or insurance.
- The accuracy of third-party estimates.
- Project pricing or financing eligibility.
- Contractor workmanship or performance.
- Completion timelines.
- The quality or suitability of third-party products or services.
Any estimates, project timelines, or general pricing information displayed on the Website are for informational purposes and may vary based on location, materials, labor, project complexity, and individual contractor pricing.
Except where prohibited by law, Roofing Rebuilder disclaims applicable implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Roofing Rebuilder and its officers, employees, and authorized representatives shall not be liable for indirect, incidental, special, consequential, or exemplary damages arising from the use of the Website or its content.
These limitations may include claims relating to interrupted Website availability, lost business opportunities, or other indirect losses.
To the fullest extent permitted by applicable law, Roofing Rebuilder's aggregate liability arising from use of the Website or these Terms shall not exceed fifty US dollars ($50).
This limitation does not apply to liability that cannot lawfully be limited or excluded, including statutory remedies or other consumer protections to the extent applicable law prohibits their limitation.
Nothing in these Terms is intended to eliminate rights or remedies that are legally non-waivable.
15. BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER
IMPORTANT NOTICE: PLEASE READ THIS SECTION CAREFULLY.
EXCEPT AS PROVIDED BELOW, YOU AND REBUILD BATH AGREE TO RESOLVE COVERED DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION RATHER THAN THROUGH A COURT PROCEEDING.
THIS SECTION MAY LIMIT YOUR RIGHT TO A JURY TRIAL AND YOUR ABILITY TO PARTICIPATE IN CLASS ACTION PROCEEDINGS.
15.1 Agreement to Arbitrate
Except for the exceptions identified below, you and Roofing Rebuilder agree that disputes, claims, or controversies arising out of or relating to these Terms, your use of the Website, service requests, submission of personal information, or communications relating to the Website will be resolved through final and binding individual arbitration.
This agreement applies to covered disputes regardless of whether they arise under contract, tort, statute, or another legal theory, to the extent permitted by applicable law.
The arbitration agreement applies only where you have validly agreed to it under applicable law.
This arbitration provision is intended to be governed by the Federal Arbitration Act (FAA), to the extent applicable.
15.2 Arbitration Administrator and Rules
Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its applicable Consumer Arbitration Rules, including applicable supplementary rules, unless otherwise required by law.
The AAA rules and information regarding arbitration procedures are available through the American Arbitration Association at:
The arbitration will be conducted before a neutral arbitrator selected according to the applicable rules.
The arbitrator may award any individual relief or remedy available under applicable law that a court could award.
15.3 Individual Arbitration
Arbitration proceedings shall take place on an individual basis, subject to applicable law.
Each party retains the right to present evidence, arguments, and claims consistent with the applicable arbitration rules.
The arbitrator will issue an award in accordance with applicable law and the governing arbitration procedures.
A court having jurisdiction may enter judgment on the arbitration award.
15.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND REBUILD BATH AGREE THAT COVERED DISPUTES SHALL BE BROUGHT ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY.
NEITHER PARTY SHALL PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR CLASS ARBITRATION, EXCEPT WHERE APPLICABLE LAW DOES NOT PERMIT SUCH A WAIVER.
The arbitrator shall not consolidate claims of multiple individuals into a class proceeding unless expressly required by applicable law or otherwise permitted by an enforceable agreement.
Nothing in this provision prevents the application of mandatory statutory rights that cannot lawfully be waived.
15.5 Exceptions to Arbitration
The following disputes are not required to proceed through arbitration:
- Individual claims eligible for small claims court, provided they remain within that court's jurisdiction.
- Claims or remedies that cannot legally be subjected to mandatory arbitration.
- Claims for which arbitration is prohibited by applicable federal or state law.
Nothing in this agreement prevents either party from contacting, filing a complaint with, or cooperating with a government agency or regulatory authority.
Nothing in this section restricts governmental enforcement authority.
15.6 Informal Dispute Resolution
Before initiating arbitration, the party seeking relief agrees to provide written notice describing:
- The nature of the dispute.
- The relevant facts.
- The requested resolution.
- Contact information sufficient to allow a response.
Notices to Roofing Rebuilder may be submitted to:
Please include "Notice of Dispute" in the email subject line.
Roofing Rebuilder will make reasonable efforts to resolve the dispute informally.
The parties agree to allow 30 calendar days following receipt of a complete notice to attempt resolution before initiating arbitration, unless applicable law requires or permits otherwise.
This informal process does not prevent either party from seeking urgent relief where legally available, and it shall not be interpreted to shorten an otherwise applicable limitations period.
15.7 Arbitration Location and Hearing Format
Arbitration shall be conducted in a location or format consistent with the applicable AAA Consumer Arbitration Rules and consumer due-process requirements.
Where permitted under the applicable rules, proceedings may take place remotely, by telephone, through written submissions, or in person.
The location and procedure must not impose an unreasonable burden on the consumer.
15.8 Arbitration Fees and Costs
Arbitration filing fees, administrative fees, and arbitrator compensation will be allocated according to the applicable AAA Consumer Arbitration Rules and governing law.
Roofing Rebuilder shall pay the fees that the applicable arbitration rules or governing law require a business to pay.
Consumers shall not be required to pay arbitration fees exceeding the amounts permitted by the applicable AAA Consumer Arbitration Rules and governing law.
Any available consumer fee waivers or reductions shall remain available.
Each party shall ordinarily be responsible for its own attorneys' fees unless an applicable law or an enforceable agreement provides otherwise.
15.9 Right to Opt Out of Arbitration
You may opt out of this Arbitration Agreement by sending written notice to:
Your notice must include:
- Your full name.
- The email address or telephone number associated with your Website submission.
- A clear statement that you wish to opt out of the Binding Arbitration Agreement.
Your opt-out notice must be submitted within 30 calendar days after you first validly accept these Terms containing this Arbitration Agreement.
If you timely opt out, neither party will be bound by this Arbitration Agreement with respect to disputes covered by the opt-out.
Opting out will not affect your ability to submit service requests or otherwise use the Website.
The remaining provisions of these Terms will continue to apply to the extent legally enforceable.
15.10 Changes to This Arbitration Agreement
Material changes to this Arbitration Agreement will be posted with a revised effective date.
A revised arbitration provision will not automatically apply to disputes that arose before the revision.
Where applicable law requires affirmative acceptance of a revised agreement, the revised terms will apply only after valid acceptance.
15.11 Severability of Arbitration Provisions
If a provision of this Arbitration Agreement is found invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
However, if the Class Action Waiver is determined to be unenforceable with respect to a particular claim or requested form of relief, that claim or request shall proceed in a court of competent jurisdiction to the extent required by applicable law.
The unenforceability of a particular provision shall not eliminate any rights or remedies that applicable law protects.
15.12 Consumer Rights
Nothing in this Arbitration Agreement shall:
- Prevent the exercise of non-waivable statutory rights.
- Limit rights to report violations to government agencies.
- Restrict legally protected cooperation with regulatory authorities.
- Eliminate remedies that cannot lawfully be waived.
- Require arbitration where prohibited by applicable law.
This Arbitration Agreement shall be interpreted consistently with the applicable AAA Consumer Arbitration Rules and the requirements of governing law.
16. GOVERNING LAW AND JURISDICTION
Except where federal law, including the Federal Arbitration Act, controls or another applicable law requires otherwise, these Terms shall be governed by the laws of the State of North Carolina, without regard to conflicting choice-of-law principles.
For disputes that are not subject to arbitration, and where legally permissible, the parties agree that proceedings may be brought in the appropriate state or federal courts serving Mecklenburg County, North Carolina.
This provision does not override a consumer's right to bring an eligible claim in an appropriate small claims court or another forum required by applicable law.
Nothing in this section limits mandatory consumer protections available under applicable law.
17. CHANGES TO TERMS OF USE
Roofing Rebuilder may revise these Terms periodically to reflect changes in Website operations, business practices, legal requirements, or available services.
When material changes are made, we may provide notice by posting an updated version on the Website or through other appropriate means.
Updated Terms will display a revised effective date.
Changes will apply prospectively to the extent permitted by applicable law.
Where affirmative acceptance is legally required, a revised agreement will apply only after valid acceptance.
Changes to the Arbitration Agreement are additionally governed by Section 15.10.
We encourage users to review these Terms periodically.
18. WEBSITE MODIFICATIONS AND AVAILABILITY
Roofing Rebuilder reserves the right to modify, suspend, discontinue, or update Website features, services, and content.
We may also perform maintenance, security upgrades, or technical improvements that temporarily affect Website availability.
We are not obligated to maintain any specific Website feature indefinitely.
Nothing in this section affects rights that cannot lawfully be excluded.
19. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
Any invalid provision shall be interpreted or limited only to the extent legally permissible.
The specific severability rules applicable to the Arbitration Agreement are set forth in Section 15.11.
20. ENTIRE AGREEMENT
These Terms, together with applicable policies and notices expressly incorporated into them, constitute the agreement governing your use of the Website.
The Privacy Policy separately describes our privacy practices and applicable consumer privacy rights.
These Terms do not supersede a separately executed written agreement between Roofing Rebuilder and a contractor, advertiser, marketing partner, or other business entity unless that agreement expressly provides otherwise.
If a separate written business agreement conflicts with these Terms, the signed business agreement shall control regarding its specific subject matter.
